Agreement to these terms
These Terms of Service govern your use of the website of Olive Tree Films, LLC (“Olive Tree Films”, “we”, “us”). By using the website, you agree to these terms. If you use the website on behalf of a company, you confirm that you are allowed to accept these terms for that company. If you do not agree, please do not use the website.
About this website
The website presents our company, our work and the services we offer to brands, agencies and organizations. Information on the website is general and may change without notice. Nothing on the website is an offer or a binding commitment to produce a project, a price or a schedule.
Every production we carry out is governed by a separate written agreement, such as a signed proposal, statement of work or production contract. If anything in that agreement conflicts with these terms, the agreement prevails.
Using the website
You may use the website to learn about us, view our work and contact our team. You agree not to:
- use the website in a way that breaks any law or the rights of others;
- copy, download, record, scrape or republish films, images, text or other content, except as these terms allow;
- use automated tools to collect content or data from the website without our written permission;
- try to gain unauthorized access to the website, our systems or our clients’ materials, or interfere with their security or operation;
- upload or send malicious code, spam or misleading information;
- present yourself as Olive Tree Films, or suggest a relationship with us that does not exist.
Our content and intellectual property
The website and its content, including films, trailers, stills, text, graphics, design and the Olive Tree Films name and logos, belong to Olive Tree Films or to our clients and licensors, and are protected by copyright, trademark and other laws.
Many films shown on the website were produced for our clients, who own them or have licensed them to us for portfolio use. Client names and logos are trademarks of their owners. They appear to describe work we have done and do not imply any other endorsement.
You may view the content for your own information and to evaluate our services. Any other use, including copying, editing, distributing or creating derivative works, requires our prior written permission and, where applicable, the permission of the client.
Private film links
Full films are not published on the website. When you request one, we may send you a private link. Private links are confidential and are provided only so that you can evaluate our work. You agree not to share, download, record, publish or forward them, and we may disable them at any time. Some films can only be shared after a confidentiality agreement is signed.
Briefs, messages and materials you send us
When you send us a brief, script, idea or other material, you confirm that you have the right to share it. Sending a brief does not create a contract or a commitment from either side.
We treat briefs with discretion and are happy to sign your confidentiality agreement before you share detailed information. Unless a confidentiality agreement is in place, we cannot accept an obligation to keep general ideas confidential, because similar ideas may already be in development by us or by others. Please do not send highly sensitive information until an agreement is signed.
How we handle the personal information you send us is explained in our Privacy Policy.
Third-party links and services
The website may link to or include content from other services, such as review platforms, video players, social networks and messaging apps. We do not control those services and are not responsible for their content or practices. Your use of them is governed by their own terms and policies.
Disclaimers
We work to keep the website accurate and available, but it is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, about the website, including warranties of accuracy, availability, fitness for a particular purpose or non-infringement.
Limitation of liability
To the extent the law allows, Olive Tree Films will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the website. Our total liability for any claim related to the website is limited to one hundred U.S. dollars. These limits do not apply to liability that cannot be limited by law, and they do not affect the terms of any written production agreement.
Indemnity
You agree to indemnify and hold Olive Tree Films harmless from claims, losses and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the website.
Governing law and disputes
These terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict of law rules. Any dispute related to the website will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you agree to the jurisdiction of those courts. Nothing in this section limits rights you have under the mandatory consumer laws of the place where you live.
Changes to these terms
We may update these terms from time to time. The current version is always published on this page, and your continued use of the website after a change means you accept the updated terms.
